Expungements & Sealing of Criminal Records

There is a common misconception that an individual with more than one criminal conviction is ineligible to expunge/seal their record. While this used to be the case, Ohio Senate Bill 337 was enacted in September 2012 broadening the scope of individuals eligible to expunge/seal their criminal record.

What is a “conviction”? All felonies and all misdemeanors of the 1, 2, 3 and 4th degree, unless exempted as a non-conviction. Minor misdemeanors and certain traffic offenses are NOT “convictions” and there is no limit to the number of these offenses that can be sealed. Some criminal offenses cannot be expunged.

An individual may be eligible to seal their record under the following circumstances: (1) one felony conviction; (2) one misdemeanor conviction; (3) one felony conviction and one misdemeanor conviction even if unrelated; and (4) two misdemeanor convictions even if they are unrelated. “Sealing” means that any record of the offense will no longer be public and cannot be seen by potential employers or others (subject to certain exceptions).

Once the conviction is sealed, an individual may legally answer that they have not been convicted of any criminal offense. Additionally, a sealed criminal record cannot be used to deny an application for a CCW permit.

If you believe that you or someone you know may be eligible to seal an offense, please contact our office for a confidential and free consultation.

F&F Supporting Community Events

Our law firm was proud to participate in two great community events this past weekend. On Friday, we played in the
Transitional Living, Inc.’s 5th Annual Golf Outing. It was a fantastic event for an extremely worthy cause (and it also helps that we won the outing!). Transitional Living is a nonprofit organization that provides rehabilitative services to adults with severe mental disabilities and assists them in achieving recovery and independent living in Butler County.

On Saturday, we entered a team (“Hustling Barristers”) in the 1st Annual Heart Chase 2013 put on by the American Heart Association. The Amazing Race-style event involved uncovering clues, solving puzzles and completing challenges throughout downtown Hamilton. We’re proud to say that with the “help” of a 3 ½ year old and 2 year old, our team finished in 11th place out of 28 teams! It was truly a tremendous event. We had a great time and look forward to participating next year.

Also, don’t forget the 2nd Annual Operation Pumpkin is this weekend (Oct. 4, 5 & 6) in downtown Hamilton. We are joining many other community members in volunteering at this fun event that offers a variety of activities for the enjoyment of all ages. Bring the family out and look for us at or near the beer booth…and, don’t worry, there is a DirecTV tent that will be showing the football games. Click here for the schedule of events. See you this weekend!

2013 Hamilton Heart Chase- Form a Team & Support a Cause

On Saturday, September 28, 2013, Fiehrer & Fritsch, LLC, invites you to join neighbors, friends and community members at the 2013 Hamilton Heart Chase. This is no ordinary walkathon and is certain to be a fun event that promotes heart health and staying active.

It’s a team competition that’s part amazing race, part minute-to-win-it.

Teams may consist of 2-5 people – bringing families, friends, and coworkers together in a community-wide competition to uncover clues, solve puzzles and complete challenges in a race to the finish line.

It’s a fun way to promote heart health.

It does not matter how athletic or competitive you are. If you enjoy staying active, and are looking for a fun activity that is as entertaining as it is challenging then Heart Chase is for you.

It’s in the heart of Hamilton.

The event will be held in a mile radius of downtown Hamilton - giving local business the opportunity to support our cause and raise awareness as our check-in locations.

Fiehrer & Fritsch will be competing in this fun event and we hope to see many of you there supporting a great cause. To join or form a team, please click here

"Drive Sober Or Get Pulled Over" Campaign Launched from Aug. 16th through Labor Day

A new federally funded program aimed at deterring impaired and drunk driving kicks off August 16th and runs through September 2nd. Local law enforcement agencies will be increasing their presence on the roadways. It does not take much alcohol to reach a 0.08 BAC, and a justified traffic stop could be something as minor as a license plate light or brake light being out. Enjoy yourself, but be cautious on the roadways.

Is the current blood alcohol limit too high for drivers? The National Transportation Safety Board (NTSB) thinks so.  The NTSB recently voted to recommend that all 50 U.S. states reduce the BAC limit from 0.08 to 0.05 for drivers aged 21 and over, nearly a 40 percent reduction.

WELCOME and thank you for visiting the newly launched website of Fiehrer & Fritsch, LLC, Attorneys at Law.

In December 2012, we relocated to the First Financial Bank Building in downtown Hamilton, Ohio, after spending the previous 12 years in the Robinson-Schwenn Building.  We could not be happier with our relocation and, in fact, we plan to host an Open House in the near future to meet and mingle with as many friends, colleagues, clients and community members as possible.

In this section, we intend to offer frequent updates on recent trends and changes in laws relevant to our community, as well as highlighting our community involvement through participation and sponsorships in various local events.

As this website will continue evolving through the addition of new content and blog posts, please consider “bookmarking” and continuing to visit our website often. As always, please contact us if there is anything we can do for you, a family member or friend. As the saying goes, the biggest compliment we can receive is a referral from a client!

Thanks again for visiting our new website and we hope you enjoy the rest of your summer!
